Step 1 · First 30 days

After you form an LLC — first 30 days (2026)

What should you do after forming an LLC? Save stamped articles, get a free EIN, open LLC checking, keep an OA and registered agent current, calendar the first annual report, map licenses/tax desks, then SEO only after the desk exists. Cross-state process map — not legal or tax advice.

By Formation Lane Editorial · Page dated 6 October 2026

The Secretary of State accepting your articles creates the LLC on the public record. It does not open a bank account, issue an EIN, write an operating agreement, or calendar the first annual report. The first ~30 days after acceptance are when most of that desk work either happens — or gets skipped until a bank, counterparty, or late fee forces it. This page is the cross-state checklist for operators who already have a domestic LLC and need the sequence, not another state filing walkthrough. Still operating as a sole prop or DBA and need the handoff map before this checklist applies? Convert a sole proprietorship to an LLC.

Neighbor desks: Get an EIN · Business checking · LLC SEO after you form · Business license after LLC · Sales tax permit after LLC · LLC annual report · Operating agreement · Registered agent.

Short version for 2026: save the stamped articles → free EIN on IRS.gov → LLC-name checking → signed operating agreement with the records → keep the registered agent reachable → calendar the first annual report (and any franchise tax) → confirm any state publication / newspaper step where the statute requires it → open sales-tax / payroll / license accounts only when the work requires them → then visibility on LLC SEO after you form. Formation shops are optional convenience — not a substitute for documents banks and the IRS already issue for free.

First-30-days desk checklist

Printable shape after articles are accepted — tax and license desks only when the facts require them.

  • Stamped articles + control number saved in two places (legal name matches SOS search)
  • EIN confirmation letter saved (free on IRS.gov after acceptance)
  • LLC-name business checking open
  • Signed operating agreement with company records
  • Registered agent address confirmed / commercial agent paid
  • First annual report / franchise deadline on the calendar
  • Publication / Certificate of Publication calendared only if the home state requires it
  • Tax / license desks listed for your facts — accounts opened only where required
  • SEO / website work only after the formation desk above exists

What should I do first after my LLC articles are accepted?

Save the stamped acceptance with the control or file number. Then get a free EIN on IRS.gov, open LLC-name business checking, put a signed operating agreement with company records, confirm the registered agent is reachable, and calendar the first annual report for your home state. Open tax and license accounts only when the work needs them.

Seven desk steps in order:

  1. Save the stamped articles and control number. Download the SOS acceptance PDF (articles of organization, certificate of organization, or formation confirmation). Record the exact legal name, formation date, and control / file number. Keep a second copy off the laptop that filed.
  2. Get an EIN free on IRS.gov. Apply only after the state entity exists. Use the official IRS get-an-EIN path — there is no IRS fee. Finish in one session; have the accepted articles and the responsible party’s SSN or ITIN ready. Save the confirmation letter for the bank.
  3. Open business checking in the LLC’s legal name. Park operating cash in an account titled to the LLC. Typical ask: stamped articles, EIN letter, ID for the controlling person, and often a signed operating agreement. Personal checking is not a substitute for LLC-name banking hygiene.
  4. Put a written operating agreement with the company records. Cover ownership, voting, money, and exits. New York and California require a written agreement kept with LLC records (not filed with the SOS). Other states may not require filing one, but banks and counterparties often ask anyway.
  5. Keep the registered agent alive and reachable. Confirm the in-state street agent on the public filing still matches reality. Commercial agents need a paid renewal; DIY agents need someone at that address during business hours. Change the agent on the SOS portal when the address or provider changes.
  6. Calendar the first annual report and franchise deadlines. Look up the home-state annual report / annual registration / Statement of Information window and any franchise or privilege tax that is not the SOS report. First due dates are often the year after formation or the anniversary month — confirm on the state formation guide, not a generic April guess.
  7. Open tax and license accounts only when the work needs them. Map sales-tax permits, employer withholding, local business licenses, and professional boards against what the LLC actually does. Open accounts on official agency sites. This is a desk checklist, not tax advice or a return-preparation service.

Formed already and still need a portal path? Jump state depth only if you need it: Georgia, California, Texas, Florida, New York, Illinois, and the rest of the 50-state formation index. After acceptance, the money and compliance shape is the same in every state: documents → EIN → banking → internal agreement → agent → renewal calendar → tax desks when needed.

Recommended next step. The first-30-days tasks most people outsource:

DIY or a formation shop. The walkthrough on this page is for saving the stamped articles, getting the free IRS EIN, opening LLC-name checking, and keeping the operating agreement and registered agent current yourself. If you would rather pay a shop to handle the filing paperwork, compare these:

Do I need an EIN before I open a business bank account?

Usually yes for an LLC-titled account. Get the free EIN on IRS.gov after the state entity exists — not a paid mill — then open checking. Banks typically want stamped articles, the EIN letter, ID for the controlling person, and often a signed operating agreement. Sequence: Get an EIN → LLC-name checking → keep the OA with records.

First-30-days desk order (cross-state shape)
DeskUsual timing after acceptancePrimary official path
EINDays 1–7 (after articles accepted)IRS.gov get-an-EIN — free; one per responsible party per day
LLC-name checking + OADays 1–14 (after EIN letter)Your bank KYC stack + signed operating agreement with records
Annual report / franchise + tax desksCalendar now; file when due / when facts requireHome-state SOS + DOR / board sites — not a generic April guess

Do not apply for the EIN while the articles are still pending. The IRS tells corporation and LLC applicants to form the state entity first. Applying on a pending filing can delay the number. Wait for acceptance, then open IRS.gov. Detail: Get an EIN after the state entity exists. If control changes later, the responsible-party update is a separate IRS desk — Change EIN responsible party.

With the EIN letter and stamped articles in hand, open operating checking titled to the LLC. Categories and document hygiene: First business checking account. Then keep a clear income-and-expense record — LLC bookkeeping after checking opens. Parking client payments in a personal checking account is how first-year bookkeeping turns into an audit story.

The operating agreement is the members’ private contract — ownership, voting, money, exits, and whether the LLC is member-managed or manager-managed. New York (§ 417) and California require a written agreement kept with company records; it is not filed with the SOS. Primer: LLC operating agreement basics. Governance compare: Manager-managed vs member-managed LLC.

The registered agent on the public filing must keep an in-state street address and be available during business hours for lawsuits and official mail. Changing the agent is a separate SOS filing in most states: Registered agent basics for a new LLC. If the principal office or mailing address moves later, that is usually an annual-report / Statement of Information path: Change LLC business or principal office address.

Do not skip the EIN-then-banking sequence, invent a pending-articles EIN, or treat a formation-shop invoice as SOS acceptance. Free IRS.gov plus your stamped packet is the honest path. Formation Lane does not apply for EINs, open bank accounts, or draft operating agreements.

Do I need licenses, sales tax, or payroll accounts in the first month?

Only when the facts require them. Taxable sales can mean a sales-tax permit; a city or board trade can mean a business license; hiring can mean federal and state withholding; some states run franchise taxes separate from the SOS annual report. List which desks apply, then open accounts on official sites. Formation Lane does not prepare returns.

Put the first annual report / annual registration / Statement of Information on a calendar with a reminder two weeks before the window opens. First due dates vary: many states start the year after formation; others use the anniversary month; some LLCs have no SOS annual report at all (for example a typical Ohio or Arizona LLC — confirm on the state guide). Franchise, privilege, or published-tax calendars (California FTB annual tax is the expensive example) are often a different desk from the SOS report.

Tax and license accounts are a process map, not advice:

Open each account on the official agency site when the facts require it. Formation Lane does not elect S corporation status, prepare returns, or tell you which desks apply to your trade.

Do I need a website or SEO next?

Not before the formation desk exists. Finish stamped articles, free EIN, LLC checking, operating agreement, registered agent, and the first annual-report calendar first. Visibility — money pages, Search Console, Google Business Profile only if truly local — sits beside that stack. See LLC SEO after you form for the month-one sequence.

Once the desk work above is in motion, visibility is a separate lane — money pages and Search Console fixes before random blogging: LLC SEO after you form. Domain and public brand can differ from the SOS legal name when you keep one public trade name and file a DBA / assumed name when required. A later legal-name change is an articles amendment, not an SEO trick. Publishing an app? The stores can show the LLC instead of your own name once you enroll as an organization: put your app under your LLC.

Do I need state-specific next steps after formation?

Yes for deadlines and portals — not for inventing a different first-30-days shape. Use your state's formation guide for the SOS annual-report window, franchise tax, and any publication step. Ohio and Arizona often have no typical SOS annual report for an ordinary LLC; Indiana is often biennial. Confirm on the state guide, not a generic April guess.

Use the home-state formation guide on this site for portal paths, fee tables, and renewal windows. Cross-state renewals primer: LLC annual report and annual registration. Multi-state work later may need a foreign LLC / certificate of authority — that is compliance, not a formation shortcut. Closing or catching up a lapsed entity is dissolve / reinstate, not a content sprint.

Later ownership desks (not first-week work): add a member, remove a member, transfer LLC ownership, buy-sell agreement, change EIN responsible party, close LLC checking.

Set up books and compliance.

Next: the money path. After the articles (or certificate) of organization is accepted:

  1. Get an EIN — free on IRS.gov after the state entity exists
  2. Open business checking — park operating cash in the LLC’s name
  3. First brokerage — only if the work needs one

Is an operating agreement required in the first 30 days?
New York and California require a written operating agreement among the members — kept with LLC records, not filed with the Secretary of State. Many other states do not put it on the articles upload checklist, but banks and counterparties often ask for a signed copy anyway. Put one in place early rather than arguing from memory later: LLC operating agreement basics.
When is the first annual report due?
It depends on the home state — do not assume every April from the formation year. Many states first due the calendar year after formation; some use the anniversary month; Ohio and Arizona often have no typical SOS/ACC annual report for an ordinary LLC; Indiana is often biennial. Map the window on LLC annual report and annual registration and on your state’s formation guide. Missing it is how companies get administratively dissolved.
What happens if I ignore the registered agent after formation?
The agent on the public filing is where lawsuits and official state mail go. If that street address bounces, the company can miss a default judgment or a compliance notice and risk administrative dissolution. Keep the agent current — DIY street address or a commercial agent — and update the SOS when you change it: Registered agent basics for a new LLC.
Is beneficial ownership (BOI) reporting still required?
As of FinCEN’s August 2026 final rule, U.S. companies are exempt from beneficial-ownership reporting and no longer need to file BOI for domestic entities. Foreign entities registered to do business in the U.S. may still have reporting duties. Details and how to spot fake BOI notices: Do LLCs file a BOI report?
Should I use a formation shop for the first 30 days of paperwork?
The primary path for EIN, banking docs, operating agreement storage, agent updates, and annual-report calendaring is DIY on official portals (IRS.gov, your bank, your home-state SOS). A formation shop is optional convenience if you want someone else to chase filings or agent renewals. A shop invoice is not a Secretary of State acceptance and does not replace the documents banks and counterparties ask for. Formation Lane is a publisher only.
Does Formation Lane complete post-formation filings for you?
No. Formation Lane is a publisher. We map desks (save stamped articles → free EIN → LLC checking → operating agreement → registered agent → annual-report calendar → tax/license accounts when needed → SEO only after the desk exists). We do not apply for EINs, open bank accounts, draft operating agreements, or file annual reports.
Is this page legal or tax advice?
No. It is a cross-state process map for operators whose articles were already accepted. Deadlines, franchise taxes, licenses, and estimated-tax calendars depend on your facts and home state. Confirm on official IRS, SBA, SOS, and FinCEN pages. Formation Lane does not prepare returns or elect tax status.
